Privacy Statement 

Logan City Council is collecting your name, address, date of birth, phone number, email address, and emergency contact details to process new gym memberships and make contact in case of an emergency. This information will only be accessed by employees and/or Councillors of Logan City Council and the Service Providers contracted to conduct activities as part of Logan Leisure Centre’s programs and classes. Your information will not be given to any other person or agency unless you have given us permission to do so or we are required/authorised by law. As a member of Logan Leisure Centres, you agree to receive SMS messages and Electronic Direct Mail (EDM) in relation to your membership and to Logan Leisure Centres programs and events offered throughout the year. Members can opt-out of receiving these SMS messages and emails at any time.

Management Authority

– Upon enrolment, you will be registered for an active ongoing booking. We will secure your ongoing chosen class day(s) and time(s) until you inform us of your intention to cancel. For instructions on how to proceed with a class cancellation, please consult the ‘Cancellations’ section provided below.

– Management retains the authority to suspend or revoke enrolment or patronage for individuals who fail to adhere to the rules of Logan Swim School or engage in improper conduct that may harm the best interests of the school, as determined by management.

– Smoking and alcohol consumption are strictly prohibited in all areas of Logan Leisure Centres.

– Logan Swim School reserves the right to consolidate classes with low numbers, providing at least one week’s notice and attempting to find a suitable alternative class.

– Logan Swim School does not guarantee teacher requests. Teacher schedules may change at any time.

Cancellation Policy

– 30 Days Written Notice: As a rollover swim school for our direct debit customers, we require 30 days written notice for cancellations, regardless of when during the term the cancellation is requested. This means if you submit a cancellation at the end of the term, the 30-day notice period will still apply from the date we receive your request.

– Transfers will only be considered under exceptional circumstances.

Fees and Payments

– Full-term fees must be paid at the time of enrolment, or you may opt for Direct Debit payments, which incur additional fees.

– Refunds do not apply.

– We do not hold places or accept part payments.

Photography and Marketing Consent

Upon enrolling you will have the option to grant Logan City Council permission to take photographs and use your child’s image in promotional and marketing campaigns associated with Logan City Council or other government agencies, at our discretion. By opting into photography and marketing consent, you acknowledge and agree that it may be used for future marketing campaigns, including but not limited to promotional emails, newsletters, advertisements, and other marketing materials related to our products or services.

General Conditions of Entry

To ensure the Centre is able to provide a high level of service in a safe, healthy, and pleasant environment for all, members must comply with the following conditions:

1. Please inform us of any pre-existing injuries or health concerns your child may have.
2. Ensure constant supervision of your children, including being present at the Centre while they’re in the pool.
3. Food and glass containers are not permitted in the pool area.
4. Please take responsibility for your personal belongings. Any belongings left at Logan Swim School will be placed in the ‘lost property’ area and may be periodically donated to charity.
5. No smoking, including vaping, is permitted in the Centre.
6. No chewing gum is permitted in the Centre.
7. Entry will be refused or a person requested to leave the Centre if the person:
   • Engages in abusive or offensive behavior: This includes the use of offensive language, threatening behavior, or any form of verbal abuse directed at staff, patrons, or other individuals within the Centre.
   • Is under the influence of drugs or alcohol: Any person who appears to be under the influence of drugs or alcohol, and whose behavior is disruptive or poses a risk to themselves or others, will be asked to leave.
   • Commits physical harassment or violence: Any form of physical harassment, including pushing, shoving, hitting, or any other form of physical aggression, will not be tolerated.
   • Engages in sexual harassment: This includes unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct of a sexual nature that creates an intimidating, hostile, or offensive environment.
   • Displays discriminatory behavior: Any behavior that discriminates against individuals based on race, gender, sexual orientation, religion, disability, or any other protected characteristic is strictly prohibited.
   • Engages in stalking or intimidation: Any behavior that involves following, watching, or intimidating another person in a manner that causes fear or distress.
   • Commits any form of harassment: This includes bullying, cyberbullying, and any other form of harassment that causes emotional or psychological harm to another person.

Waiver

I acknowledge that I am aware there is an inherent risk of injury, death or ill health resulting from the use of the Logan Leisure Centres’ facilities and services and from the participation in exercise programs generally.
I, therefore, undertake to utilise these facilities and services only at my own risk, and I hereby waive on behalf of myself, my heirs and executors hereafter liability against Logan City Council and its officers, employees, contractors and agents for any injury, illness, death or adverse changes in my medical condition or state of health (whether permanent or temporary), arising directly or indirectly from my use of facilities or other services provided, whether supervised or not by Logan City Council staff. I acknowledge that the services which are subject to this waiver of liability include, but are not limited to, fitness and dietary assessments, exercise programs, group fitness classes, use of the pools and all advice and directions relating to such services.
